Germany is an important capitalist country in the central Europe, it is also a nation-state, which adopts the ‘jus sanguinis' citizenship policy. Such characteristics reflect, the situation which Germany faces, is similar with China. Therefore, the research about Germany's diaspora policy is very helpful for our nowadays Overseas Chinese Policy. This article focus on the research about German diaspora policy, such as the history background of the Central and East Europe German back to Germany after the world war ?, the process of this policy, the legal framework for the protection of the overseas German, and the experience and problem during the integration of the overseas German. By solving these problems, the reason, the motivation, the measures and the effect of the German diaspora policy will be found.So we Chinese diaspora work will learn some experience from this work.First of all, the paper is about the introduction describing the background, the current status, the idea and the possible innovation of this research. And then the paper introduces the identification, the historical background and the destination of post-war German diaspora policies. And then the paper introduces the relevant law about the protection of the overseas German. It includes two parts: the definition of the Expellees' status and the integration. The fourth chapter is about the experience and lessons from the practice of the post-war German diaspora laws and policies. And the last part summarized the lessons of the German diaspora law and the implications for China on the foundation of the first four chapters.The conclusion of this paper is as follow: after the world war ?, the federal government try to achieve the state's goals through the overseas German return policy,not only eliminate the influence of the war, improve the national image; but also give those overseas Germans humanitarian aids, and protect the interests of overseas German groups. Therefore, this paper agrees that the approprite law must be the institutional foundation of the diaspora's affairs.
