The Dilemma And Reform Of Copyright Law In Cloud Computing Environment

The Cloud Computing is considered as another important reform of the Internet technology, and even considered to lead a new era of network technology services. The technological revolution inspired by cloud computing will reduce the cost of knowledge acquisition, and also make the production of knowledge easier and more convenient.The first chapter of this paper introduces the new ways of creating works and communicating in the cloud computing environment. PaaS business service model in Cloud computing environment has changed the way of creating works, the creation of a work has openness, collaboration and sharing features, Paas platform will be a higher level of human cooperation. Another business model Saas model has changed the way of spreading and using works. Do not need to download the software works to the local can enjoy the service function of the software in the cloud. The second chapter discusses the dilemma of copyright system in Paas mode, including the two aspects, on the one hand, the creation of the Paas platform is more and more, and the number of co-authors is exponential growth in the past, which will result in a great difficulty in the coordination of communication between the authors and the right to exercise. And this difficulty cannot be resolved in the current system of cooperative work of our country. On the other hand, due to the Paas platform to provide the share of software modules for the creators of the exchange platform, so a lot of interpretation and assembly works will also be expected to. But the use of the traditional "pre authorization use" is not able to meet the needs of the vast amount of work in the cloud environment. The third chapter is to discuss the nature of the works in SaaS mode. On the one hand, the use of software in SaaS mode is no longer need users to download copy to the local, temporary use mode to replace the use of the way; non software works in the cloud computing environment through online browsing way to spread, temporary replication phenomenon in cloud environment will greatly increase, cloud service providers in order to improve data security to take the redundancy storage backup means, although belong to copy, but should not cover the effectiveness of the right to copy. So on copy right based control works in the interests of the market situation is broken in the cloud and the cloud environment replication right to limit the enhancement, the right of reproduction will become useless; on the other hand the SaaS Model in the dissemination of works also does not conform to the information network dissemination behavior, due to the dual attributes of computer software of "work" and "tool", in the SaaS user terminal did not get software works "substance", just to get the service functions of software, so the right to network dissemination of information scope of validity cannot cover the utilization of such works. In the fourth chapter, this thesis explores the changes of copyright law in the cloud computing environment. First of all, in the face of the huge amount of cooperative work and the number of co-authors in the cloud environment, the paper suggests that the copyright ownership of the cooperative work and the exercise of the priority principle, and the establishment of the cooperative work of the representative system. Secondly, the innovation of copyright licensing mechanism, to further explore the authorization of the offer, and the use of cloud computing technology and large data collection, the establishment of the copyright information giant network. Finally, for the qualitative analysis of the behavior of the SaaS model, it is suggested that the system of our country's rental right is to be re-re and the expansion of the works, so that the adjustment of the works in the new environment can be adjusted.
