The development of the Internet brings convenience to people's life. Meanwhile, problems are also following. Disputes between Internet giants bring a heated discussion on "Robot Exclusion Protocol". In this paper, the history of " Robot Exclusion Protocol", the nature of the " Robot Exclusion Protocol", the related cases, and the legal issues of " Robot Exclusion Protocol" in the case of 3B. It is considered that the protocol is not a technical measure. In this paper, The idea that "Robot Exclusion Protocol" is a kind of technical measures is not be agreed. And the action that right holders knows the existence of illegal action but do not stop it or the action that right holders do not put a "Robot Exclusion Protocol" is not an implied license certainly. The relationship with the Copyright Law should be considered. The action which robots do not obey the "Robot Exclusion Protocol" may in violation of the Unfair Competition Law. However, abuse of "Robot Exclusion Protocol" may be regulated by Anti-Monopoly Law.
