Research On Chinese Legal System Regarding Risk Assessment Of Non-native Species

With the degree of trade globalization deepening, humans could take trade activities through multiple channels, which helps the "alien species" also have more channels to enter other ecosystems in the world and results in the tendency of alien species invasion. Alien species invasion could severely damaged the local ecological environment and restrict the local economic and social development. Many countries and regions have formulated a series of laws?rules and regulations to prevent alien species invasion through legislation. Since China's reform and opening, the opening degree deepening and the import and export trade growth rapidly, which also have been bringing in many alien species, causing serious alien species invasion. According to the "invasive alien species investigation report" which promulgated by China Ministry of Agriculture in September 2014 shows that the invasion of species reaches 529 kinds, more than 100 kinds species have caused widely acreage serious harm. Up to now, according to the data from the Ministry of Agriculture Invasive Alien Species Prevention and Control Research Center shows that China's current number of invasive alien species has risen to 754 species. Just over a year's time, it added 225 species. It follows that the prevention and control of alien species invasion in our country is still insufficient, it is a important work to protect people's health life and the stability of ecological system, especially the biological diversity. Therefore, how to prevent the invasion of alien species effectively and what measures should we take have become one of the important issues of environmental protection work.The object of this study is that how to build alien species risk assessment system to prevent the invasion of alien species, which aims to deal with the increasingly serious problem of invasive alien species. The main purpose is to summarize the legislative experience for reference and reflect our deficiency by introducing comparing and analyzing the domestic and foreign legislation on alien species risk assessment system and summarizing the basic information about prevention and control of invasive alien species legislation of our country, and put forward a basic idea of building alien species risk assessment system to prevent the alien species invasion, and to provide some useful ideas to strengthen the legislation of the invasive alien species.This paper is divided into five chapters:The first Chapter gives a definition of alien species risk assessment system, introduces the environmental hazards of alien species invasions and than elicit the necessity of Construction of alien species risk assessment system; The second chapter describes the legislation of alien species risk assessment system from two standpoints, the central legislation and local legislation; The third chapter is the discussion and analysis to the present situation of alien species risk assessment system; The fourth chapter introduces and analyzes the domestic and foreign dynamic state on the legislation of alien species risk assessment system; The fifth chapter is to cerebrate that how to improve the alien species risk assessment system to prevent the alien species invasion.This paper argues that, in the worsening trend of alien species invasion, alien species risk assessment system is the most effective method to prevent the alien species invasion with the lowest cost. At present, it is necessary to establish a relevant legal system to make sure the alien species risk assessment system fully plays its role and help the worsening trend of alien species invasion to get effectively controlled.
