Research On The Network Of Litigation From The Perspective Of Civil Litigation

With the development of economic globalization, the degree of the globalization and socialization of litigation is more and more deep, the slow process of traditional litigation is becoming more and more obvious. In recent years, under the support of the modern network technology, remote trial, the trial live, electronic service, electronic evidence, management system of judicial case, management system of the case execution, electronic signature system have come into being. This new pattern of electronic judicial is step by step to change and subvers the traditional judicial model, by the characteristics of the low cost, convenient, efficient.This paper discusses the related issues of litigation network in China, briefly introduces the related information of litigation network at home and abroad, and expounds the relevant contents of the litigation network. This paper analyzes the main problems of the litigation network in China, and on this basis, based on the reality of China's national conditions, on how to implement the litigation network,puts forward my own proposals.The full text is divided into four parts, in addition to the first part of the introduction, the structures of the other three parts are as follows:The first part mainly expounds the concept and characteristics of the litigation network, the main content of the litigation network.Firstly, the concept and characteristics of the litigation network are expounded. This part describes the concept of litigation network in detail, and details the distinction between the concept of litigation network and the similar concepts, for example,electronic court, judicial case management system, and so on. This part elaborates the characteristics of the litigation network from five aspects, makes people have a clear knowledge and understanding on the concept and characteristics of litigation network.Secondly, this paper expounds the main contents of the litigation network. This part explains the main contents of the litigation network.This part from the three aspects: constructing a unified national litigation network system, creating a unified national litigation network platform, unifying national rules of litigation network, constructs the three-dimensional model of the litigation network, reveals the trend of the future litigation network.The second part mainly expounds the main problems of litigation network, and the reason analysis of the main problems of litigation network. First of all, this paper expounds the main problems existing in the current litigation network in our country. This part from three aspects:our country has not built into the national unified litigation network at present,the design of the litigation judicial software is too simple, the interface of litigation network platform is fragmented, comprehensively elaborates the main problems in the proceedings of the network in our country at present. Secondly, it analyzes the reasons of the main problems in the litigation network in China. This part from three aspects:the complexity of the litigation activities, the differences of the court's own conditions, the diversity of the standards of technical, deeply analyzes the main reasons of the problems of the litigation network in China.In the third part, the paper mainly expounds some countermeasures to solve related problems of the litigation network. This part from the four aspects:strengthening of the top-level design, perfecting the related system, improving the quality of the personnel,ensuring network security, in view of the main problems of the current litigation network in China, puts forward a concrete and feasible solution.In short, this article that is based on the domestic and international research and practice of the litigation network in recent years, from the perspective of civil litigation, in view of the main problems of the current network in our country, puts forward some countermeasures and suggestions. I hope that the thinking of the network of the author, can provide some references for the construction of the information system of the court system, in the current round of judicial reform.
