By the end of 2014,China’s civilian vehicle has reached 154 million,of which private cars has exceeded 100 million.The public transport travel structure has undergone fundamental changes.As a family consumer goods,automobile’s maintenance costs accounted for the largest cost,which go throughout the entire life cycle of its usage.Automobile maintenance industry is an important livelihood services,relating to the safety and environment protection requirement of the vehicle,and also relating to the vital interests of the consumers.With the rapid development of China’s automobile industry,automobile maintenance industry also began to flourish,the profit of the automobile industry is gradually inclined toward the aftermarket,which provides a golden opportunity for the development of the automobile maintenance industry,but also challenges for the regulation on the maintenance industry market.The development of the automobile maintenance industry is unbalanced and the supervision relating to the market is imperfect,for example,the access to the information is unbalanced between operators and consumers,the price of spare and accessory parts is monopolized by the automobile manufacturers,the maintenance technology is non-transparent,the standard of the maintenance technology is not unified,the credibility of the automobile maintenance operators is lacked,all of which infringe the legal interests of consumers.The law, regulation and industry standards on automobile maintenance industry include:“The Atmospheric Pollution Law of the People’s Republic of China”(2015),“The Road Transport Regulations of the People’s Republic of China”(2012),“The Road Transport Practitioners Provisions”(2016),“The Vehicle Maintenance Service Specification”(2011),“the Vehicle Maintenance Regulations”(2016) and “the Management Practices Implementation of the Automobile Maintenance Technical Information Disclosure”(2015),“The Management Regulation on the Technology of the Road Transportation Vehicles”(2016),“The Opening Conditions of Automobile Maintenance Industry”(GB/T 16739-2014).These laws and regulations constitute the legal system regulating the automobile maintenance industry. However, because the market regulatory body system, industry technical standard system and the credit system of the market are not perfect,the automobile maintenance is not well developed.Therefore, improving the market regulation legal system of Chinese automobile maintenance industry is important for the sustainable development of the automobile maintenance industry.In this paper,in addition to the introduction and conclusion, there are five parts:The first part is an overview of the regulation of automobile maintenance industry market.On the one hand,this part describes the concept and classification of automobile maintenance and automobile maintenance industry,and describes the characteristics of the channel and automobile maintenance services market,as well as the interpretation of the regulation on automobile maintenance industry market.On the other hand,it describes the development process of China’s automobile maintenance industry,and explains the need for regulation on the automobile maintenance industry market.The second part is the general theory of the regulation on automobile maintenance industry market.On the one hand,this section explains the theoretical basis of the regulation on this market,including asymmetric information theory,the theory of the tendency of consumer protection,state intervention theory and transaction cost theory.On the other hand,the basic principles of the regulation on this market have been explained.The main principles involve the principles of the economic democracy,moderate intervention,the economic fairness and the economic benefits.The third part analyzes the status and problem of the legal system of regulation on this market.This part is based on the summary and analyzation of the current situation and problems of this market one by one.The problems of China’s automotive maintenance industry are imperfect,such as the market regulation body system,market access system,standardization system and market credit system.The fourth part is the inspection about the regulation system of automobile maintenance industry market in foreign countries and its enlightenment to China.This section analyzes the regulation system for three developed countries,such as the United States,Germany and Japan.Drawing on the useful extraterritorial experience will bring enlightenment about how to improve China’s regulation system of the automobile maintenance industry market.The fifth part is the measures of improving the regulation system of the automobile maintenance industry market. Based on the analysis above,I try to find some suggestion.We need to:first,build the subject system of regulation;second, improve the market access system;third,improve the standardized institutional system;fourth,improve the credibility supervision system.
