Research On The Farmers’ Land Rights And Interests In The Reform Of The Household Registration System

The household registration system, as a basic national administrative system, have a very profound impact to the management of the country and the people’s basic living.Our household registration system played a very important role in the history of the development of population management, social security, national economic development and so. However, with the economic development, urban-rural dual structure produced by the household registration system has become a town of resistance of urbanization. In recent years some provinces are constantly trying to reform the household registration system and achieved some results, but there are also problems and the issue of farmers’ land rights and interests is a very important part. Such as black-box operation, the presence of land for household and so on, have damaged the farmers’ land rights and interests, and hinder the process of reform of the household registration system. The reason is multifaceted, such as fuzzy rural collective land ownership and imperfect market. This paper attempts to analyze the multidimensional problems and the reasons of farmers’ land rights and interests in the reform of the household registration system combined with examples of some provinces’ reform, then put forward some countermeasures, such as the reform of collective land ownership system and rural land market-oriented reforms, to safeguard farmers’ land rights and interests in the reform of the household registration system.The first part is an introduction, a brief introduction of background, significance, current research as well as research ideas, methods, focusing on difficulties and possible innovation. The second part describes the household registration system and the farmers’ land rights in the different stages of the development process since the founding, indicating that the two complement each other in the history of development with interwoven fusion phenomenon. The third part is a collection of examples of some provinces and cities such as Zhengzhou City, Chongqing Municipality, Guangdong Province and introduces the current infection of farmers’ land rights and interests in the reform of the household registration system, as large differences in local reform, farmers’ not wanting to give up land rights in the reform, and the problem of the damage to the farmers’ land rights in the reform, etc. The fourth part is the analysis of the damage to the farmers’ land rights and interests, and the author believe that the main reasons are the defective system of collective ownership, government financial dependence on land, the land requisition compensation lacking of standardization, imperfect market-oriented mechanism and other reasons. The fifth part is some suggestions on the protection of farmers’ land rights and interests that the author puts forward, such as the complete set of laws and regulations, reasonable policy guidance and the increase of financial investment, the reform of rural land system, and the possible innovations is from the outside of the legal system intrinsic collective land ownership system and the market itself to analyze the problem of the farmers’ land rights and interests in the reform the household registration system. By dynamic binding of land system and the household registration system, the author presented a clear and collective ownership of rural land market liberalization proposal. The sixth part is the conclusion and the author believe that if we hope the reform of the household registration system to succeed, we must protect the farmers’ land rights and interests, the only way to promote the development of urban-rural integration.
