Since the advent of the condominium ownership, theory circle of our country is the are concerned, and in later legislative circle determine down. At this time, and buildings distinguish ownership theory research is vast, however, in the practice process of condominium ownership system is still not completely solve practical problems, such as the existence of the disputed area parking problem, club overhead layer, such as building ownership problem is because these disputes will cause the social contradictions. Therefore, it is urgent to solve these problems. In this paper, according to the building to distinguish the exclusive part of the ownership and common parts division standard to start, because of, it is the division standard is not clear, will cause the related issues.This paper mainly studies the path, first of all, the related theory of building differentiation ownership is expounded, mainly for the exclusive right and common right of comparative analysis, secondly, lists of condominium ownership issues, exclusive right and common right of the conflict and, in the exclusive part for all countries and co a part of the relevant legal provisions, comparative analysis compare what is suitable in our country by building ownership proprietary parts and common parts division standard, finally, in view of our country condominium proprietary parts and common parts should start from what aspects, in which the main purpose is to solve the practical problems in our country the ownership of building distinguishing.
