Research On The The China Customs Enforcement System Under The Background Of Trade Facilitation

Customs is the connector in a nation’s foreign trade, It plays very important place in a country’s foreign trade. The rapid development of our social economy, and the changing of the domestic and foreign environment put forward higher requirements to the Customs. As we all known, traditional Customs service has been unable to satisfied the reality. Under the trend of global trade facilitation, as the supervision and management organization, the Customs has a great responsibility. So, China’s Customs should reform in constant reforming, so that the various enforcement systems can meet the needs of the development of real economy.However, Zhanjiang "9898" smuggling cases, xiamen yuanhua smuggling case also warning us that the there are many gaps between China Customs law enforcement system and the advanced developed countries, some system still cannot meet the requirements of trade facilitation. Thus, it is very necessary to analysis and research on system of existing Customs enforcement system based on its national conditions.This article mainly expounds from four aspects: Firstly introduces the nature 、functions and the development history of the Customs. Secondly, analyses the international Customs enforcement system, mainly analyzes the United States, the European Union, Japan and international treaty provisions of Customs enforcement system, so that we can learn their advances experience for China’s Customs reform. The third part expounds the existing problems in the current Customs enforcement system in our country, including the confusion of legislation, unscientific of Customs declaration, the incomplete of the regulatory system the lacking of law enforcement supervision, the deficient in the international cooperation and the corruption of Customs team. The last part introduces reform measures to the existing Customs law enforcement system. Include: perfecting the relevant laws and regulations in legislation, carrying out a system of classification, and referencing the AEO system; intensifying supervision and pursuing the port enforcement system actively, paying attention to the multi-pronged intensify supervision, paying attention to strengthen international cooperation and the construction of a clean team.The author thinks that Customs enforcement system reform should be based on China’s current national conditions, foreign advanced Customs enforcement system and the present situation of the international community. It needs to confirm to the trend of the trade facilitation. Therefore, China’s Customs can plays its proper functions and lay a foundation for the realization of trade facilitation.
