The Research Of The Legal Matters Of Women Who Lived In Widowhood Or Chose To Remarry In The Tang Dynasty

The Tang Dynasty was one of the golden ages of China,and the law of Tang Dynasty had learned widely from others'strong points of preceding dynasty,and the law is influenced widely and constantly.Under the system of combination of etiquette and law,many princesses chose to remarry,even third married which stand out.Many researchers think the reason of the phenomenon is the influence of Hu nationality's marriage customs,and the result was the popularity of pudicity idea had not been considered.So,as the princesses wasm the privilege class,what about the common people?The text stand the point of legal history,and there is the basis of the Code of the Tang Dynasty,and kinds of assizes,many informations of DunHuang documents,we try to analyse the legal matters of women who lived in widowhood or chose to remarry in the Tang Dynasty,especially the legal rights.The text is constituted by four parts.The first part has been discussed the legal system of Tang Dynasty which was guided by the Confucianism,and the guiding ideology of the legal system,the characteristic,and the place of the law of the Tang Dynasty in history.The second part has been discussed the legal rights and the limitation that included two sides about property of late husbands and adoption of women who lived in widowhood in the Tang Dynasty.The third part included the analysis of the reasons of women who had a late husband chose to remarry,and later,there is the discussion of the legal consequence that about the identity and property.The last part,we get away from the male-dominated age that women usually took a back seat.And we can analyse the enlightenment by the way of thinking the legal rights that women who had a late husband-the weak owned,and thinking the social reality of China concurrently.We can see,the productivity of Tang Dynasty is too poor,and because the small-scale economy is the leading role,the economic base determines the superstructure,the advantage of male labour force in the traditional agricultural economy result in the phenomenon that female usually took a back seat.Because of the phenomenon,and the pudicity idea that had been popular constantly for a thousand years,the widow must be the weak.But the women who lived in widowhood or chose to remarry had some legal rights,and some rights which,for example,about the providing for the aged,and the legal protection for the widow's property that followed with the marriage express the respect of women's family task,all of these are worth to self-exam and learn to the people who live in here a thousand years later.
