Kurt Bayertz divided the ethic of genes into two positions:the subjective theory and the substantive theory.The latter insists that human beings are united,independent,and strictly regulated entities,and that improper intervention and control from genetic technology on this entity can lead to serious ethical catastrophes.Since this position cannot explain the fact that human history is constantly transforming nature and transforming itself,and lacks theoretical basis,it is not suitable as the philosophical foundation of gene ethics.On the contrary,Subjective theory emphasizing people's subjective initiative and moral subjectivity,gene technology can bring self-evolution and promotion of moral autonomy,expansion of human dignity together.The subjective theory's problem is: it cannot clearly point out the goal and direction of self-evolution,cannot guarantee the social validity of theory.The difficulty of traditional gene ethics is rooted in its research vision has never been able to get rid of "technology-ethics","subject-object" and other Analysis framework of binary opposition.This paper attempts to break down the two major limitations of traditional gene ethics from the perspective of phenomenology,including Heidegger's philosophy of ontology,Merleau Ponty's phenomenology of the body and the theory of materializing morality and use the limitation and generation of context as the main guiding principle,"consultations jury" and "technical mediation " as the basic method,to explore a new way for the research of gene ethics.
