The research on women's law in Qin and Han Dynasties is a traditional and new issue.Because the dispersion of the original material is hard to find,it brings many difficulties researching on the legal status of women,but in recent years the unearthed bamboo slips of Qin and Han Dynasty supplement the new material for the research.The author tries to collect the information about this period of women "s legal status from bamboo slips of Qin and Han Dynasty,on the basis of the existing research results,rearranging the women" s legal status reflected from the bamboo slips of Qin and Han DynastiesThis paper is divided into four chapters:the first chapter analyzes the legal status of women in the marriage and family.This chapter explores women's marital autonomy in Qin and Han Dynasties,including marriage autonomy to terminate their marriage and remarriage,remarried autonomy.As well as the status of women in marriage and family,we can see that what kind of status and what kind of role women play in the marriage and family.It is not difficult to find that the early Western Han Dynasty social concept is more open to women,women in marriage,family,there is a certain right;The second chapter analyses the legal status of women in economic society through a large number of bamboo slips.We analyze the achievements and status of women in family and social economic activities according to the related articles and materials.In the economic activities tradition of the family,we proceed from the identity inheritance and property inheritance,identity inheritance is inheritance of women's household sovereignty,if a family without a male heir,to prevent household certainly need a legitimate son outside the family member of the family,then women become successor.in the inheritance of the family property,laws support women's property inheritance;in women's participation in social and economic activities,the author tries to analyze the industry which women are engaged in at that time,women in this period can appear in public to do business,to participate in the economic life,when we analyze the reasons,we can also deeply understand women's status of economic life in Qin and Han Dynasties.The third chapter is the status of women in legal disputes.This chapter starts from two directions,that is to separate women from the subject of crime and the victim,the law of the Qin and Han Dynasties respectively gives the punishment and the protection.And make a comparison between the woman and the man,it is not difficult to see that the law is not fair in that period,revealing the fact that women's status is not as good as men.The fourth chapter is women's social view of the Qin and Han.This chapter starts from women's style of the Qin and Han Dynasties and the mainstream view on women led by the state,it is based on the background that the Qin and Han Dynasties is a period of great social change and a improving time of social system,the style that women show in society is different from the main value led by the state.This article analyzes the status of women in social life,economic life,legal disputes and social views from the legal point,and highlights the importance of women in social life.Through the analysis of women's status in a legal dispute,we can reveal the laws of Qin and Han Dynasties not only protect women but also despise women,so we cannot simply pointed out the level of the legal status of women in the Qin and Han Dynasties,in Qin and Han Dynasties women's legal status is complex,there is multiplicity and contradictions.
