The Study Of The Legal System In Taihang Area During The Anti-japanese War(1940-1945)

During the Anti-Japanese War,Anti-Japanese base areas that under the leadership of the Communist Party of China(CPC)plays an important role,it not only attacks the Japanese invaders externally,but also fights all traitors,spices and breakers who endanger Anti-Japanese democratic political power.Therefore,the construction of the Anti-Japanese base areas in the whole process is related to the the victory of Anti-Japanese War and consolidation of Anti-Japanese democratic government.Legal system construction is very important base part of it.Only by legal construction smoothly,can it provide basis for CPC and Anti-Japanese democratic government to work and to guarantee the rights and interests of the people and social order.Taihang area is the main component of Jinjiluyu Anti-Japanese base area,it is also the most concentrated area of the CPC leading bodies at that time.Therefore,the research of legal system in the Taihang area is not only beneficial to strengthen the overall study of the Taihang area,but also practically significal for the contemporary law.This paper is divided into seven chapters.The introduction part of this article gives an account of the selected topic reason and the significance,as well as the research overview,difficult point of the paper and related aspects such as definition,research methods and shortcomings.The first chapter mainly introduces background of the Taihang area during the Anti-Japanese War,and the feasibility and necessity of the construction of legal system in this area.This part mainly introduces the origin and development of the Taihang area and the process of legal system construction from scattered to the unified process.The second chapter introduces the interim council and county legislature parliament and constitutional documents.The focus of this chapter is about the electoral law in the taihang area,land legislation,criminal legislation,marriage legislation.The third chapter mainly expounds enforcement of the various laws in the Taihang area,espcially achievements and problems in the process of execution.The fourth chapter is given attention to judicial construction of Taihang area.This part presents the establishment of judicial authority and related legal system,etc.It presents the main situation of the judicial work in Taihang area at that time.The fifth chapter presents various forms of the legal publicity and education in Taihang area,such as winter-study,night classes,mass meeting and so on.The sixth chapter summaries the historical role and deficiences of the construction of legal system in Taihang area.Conclusion part is the overall summary of this article.It not only points out the result of the construction of legal system,which mobilizes the enthusiasm of the people's Anti-Japanese and maintains the Anti-Japanese democratic regime,but also analyses the resons of the problems appeared in the process of legal system construction.These achievements and problems are worthy of attention in the research on Anti-Japanese base areas.
