In recent years, with the continuous deepening of the medical and health system reform in our country, the popularization of medical knowledge of the people, and strengthen the consciousness of safeguarding rights.Patients and their families are getting higher and higher requirements for medical and health services, leading to an endless stream of disputes between doctors and patients.After a lot of medical injuries events,many medical personnel choose to take a helmet, steel stick to work.Although this can protect medical personnel from personal injury,it is only a temporary solution,contradictions between doctors and patients still exist, and increasingly intensified.Therefore, in the above context, the medical staff in the heavy clinical work with a relatively easy way to understand, familiar with the rights of patients and their own obligations, to maximize the maintenance of patients and their own rights and interests.Objectives:On the basis of existing laws and regulations in our country, we can make out the patient's rights handbook for the common use of both doctors and patients in the diagnosis and treatment process,and puts forward the improvement measures to the clinical work and medical education teaching.The aim is to improve the knowledge level of medical staff(including medical students) and to improve the legal management of modernhospitals.Methods:In this study, through consulting literature and analysis of the health laws, rules and regulations, work out the patient's related rights flow chart in the process of diagnosis and treatment, according to the flow chart making the questionnaire, using research methods of medical staff and medical students on the cognitive status of patients' rights were investigated.After the questionnaires were collected, the database was established by Epidata3.1, and the data were analyzed by descriptive statistics, statistical inference and test by using SPSS19.0 software.Results:1.The questionnaire results show that:(1)The relevant provisions of the cognitive attitude of clinicians interrogation level is relatively high,but on the "if you do not pay attention to the skills of patients with adverse consequences will be liable to assume legal responsibility" is relatively low cognitive level,only 30.2% of the people are very aware of this provision, only 4.6% of the nursing staff.(2)There is still a lack of attention to the standardization of medical records writing by clinicians.The patients' electronic medical records of the door(emergency) may not be modified to answer the correct rate of only 14.6%,and the duration of hospitalization for the first time was 8 hours and the correct rate was only 22.1%.And the correct rate of medical students in these two regulations is higher than that of the clinicians.(3)There is no obvious difference between culture degree and work experience of the technical personnel to patients right cognition, but the overall cognitive situation is relatively low.(4)Nurses' knowledge of some laws and regulations is higher, but the lack of independent thinking.93.5% of the nurses thought it is wrong that the doctor's advice,although illegal, but is good to the patient, should continue to implement.But can choose to issue a doctor's advice to the doctor's objection to the 90.7%.And report to the person who is responsible for the management of the medical service of the Department in charge of the doctor's office or the medical service when necessary is further reduced to 82.4%.(5)The cognition of medical students to patients' rights is lower than that of clinical doctors.Only 10.3% of the students very knew the medical staff is not the duty of careshall be liable for the damage caused by the patient,only 11.4% of medical students are very aware of the legal liability of patients with adverse consequences caused by speaking skills.And, there is no significant difference between the practicing physician qualification examination of students, did not pass or not to participate in the qualification examination of the students and the students did not have a clinical practice.2.According to the results of this research, the patient's rights Handbook is formed.Conclusions:1.The patient's rights handbook has changed the way in which the past is boring,converse the obscure law into the language of easy to understand.Corresponding the process and rights,and to make seemingly unrelated legal and medical knowledge together.Forming the legal consciousness and legal thinking in the reading and practical work,so as to absorb the knowledge of law, improve the legal quality of medical personnel.2.It is suggested that the health law should be listed as a compulsory course in medical colleges, and to take the examination mechanism as strict as medical curriculum,to cultivate the legal consciousness and legal concept of medical students.In the stage of clinical practice for medical students, not only to clinical education professional knowledge, more to study the legal issues encountered in clinical, and interactive with patients and gradually grasp the patient's rights and cultivate legal thinking and legal capacity.3.Strengthen the legal consciousness of management at all levels of the hospital authority.Hospital should according to law to construct the modernization of the legal hospital.And pay attention to the training of legal knowledge of the technical department personnel, the overall improvement of patients legal rights awareness of the technical staff,and create a good atmosphere of legal consciousness.4.Although the existence of some patients' rights in various laws and regulations,departmental rules and regulations, but the effect is not consistent, mutual contradiction,lead to aliasing in the implementation.Medical personnel is also an urgent need for a system, standard and special patient right law learning and maximize the maintenance of the rights of patients, so as to protect their own safety, reduce the occurrence of medical disputes, avoid the occurrence of medical violence events.Therefore, the patient's rights legislation is not only to meet the needs of the community, but also an important basis forthe current solution to the doctor-patient contradiction.
