Restriction And Compensation Of Guangzhou Historic Buildings Protection System To People With Conservation Responsibility

Protecting historic buildings takes an important role in the practice of cultural heritage conservation.But in reality,the problems faced with historic buildings conservation are more than technical matters.The more collision and resistance are that many people think that protecting historic buildings will restrict their owners' or users' rights,and they regard historic buildings as the Incantation of the Golden Hoop.With the introduction of Historic Buildings and Historical Style Area Protection Regulation of Guangzhou and the promulgation of the protection list of Guangzhou Historic Buildings,the effort of historic building protection in Guangzhou has entered the legal track.But protecting historic buildings is criticized as infringing the rights and interests of proprietors and making rights and obligations not equal.And what is more,there are quite a few misunderstandings among government administrators in the judgment on the rights and responsibilities.This article is based on rights and obligations,restrictions and compensation.Through sorting out the relevant laws and regulations and carrying out field research and interview,in the theoretical level,this article is trying to untangle the restrictions faced by people with conservation responsibility in the historic building protection system.And by contrasting with ordinary building proprietors,it is trying to answer what additional restrictions faced by people with conservation responsibility than ordinary building proprietors.At the realistic level,based on the summary of the relevant laws and regulations,it responds to the problems existing in reality,attempts to answer how to compensate the additional restrictions faced by people with conservation responsibility and put forward suggestions of compensation mode.This paper is divided into five chapters and in the structure can be divided into two parts:The first and second chapters are the first part,and they put forward the research entry point and the research object.that is,researching the problem of the restriction and compensation of Guangzhou historic building protection system from the perspective of rights and obligations.The first chapter introduces the research background,meaning,purpose,content,frame and method,as well as literature review,in order to understand and know well the current trends and results of historical building research and provide argument basis and theoretical basis for the subject.The second chapter introduces the basic research related to historic buildings,including the interpretation of historic buildings,the comparison of the protection system of historical buildings and the protection system of cultural relic buildings,and the setting of restriction and compensation in the historic buildings protection system both at home and abroad.The third,fourth and fifth chapters are the second part,which is also the core part of this article.By contrasting with the ordinary building proprietors,the paper mainly clarifies the additional restrictions faced by people with conservation responsibility due to Guangzhou historic building protection system in the course of identifying,renovating and repairing,as well as using historic buildings.It also put forward compensation proposal.Finally,the conclusion concludes that the additional restrictions on people with conservation responsibility in Guangzhou historic building protection system are mainly that the "historical buildings can not be removed" limits people with conservation responsibility to carry out the land redevelopment,and non-slight repair of the value elements brings about procedural restrictions and restrictions on repair standards.At the same time this article clarifies the people's understanding of Guangzhou historic building protection system: identifying historic buildings does not involve property right relationships and does not constitute a levy,repairing historical building is not heavily limited,both historic buildings and ordinary buildings can not be rebuilded freely,the historic building protection system does not affect the ues of historic buildings people with conservation responsibility.
