Legal System About Contaminated Sites Remediation In China

With the development of industrialization and urbanization,a large number of urban relocation of industrial enterprises left and closed,causing a lot of urban land have been contaminated.Most of the polluted lands are located in the center of city--indetectable and serious polluted,which are threatening to the environment and human health.So,it's time to repair contaminated soil.However,because the study of contaminated land has just started in China,we are facing with many problems,such as,laws and regulations dispersion,the lack of systematic and principled provisions,proper ability,etc.By contrast,many developed countries take pay attention to the areas of soil pollution prevention and control,earlier.The United States,Europe,Japan and Taiwan of China,which are meaningful in the whole world.,had established perfect soil pollution prevention and control system in the area of legal.This thesis will analyze ways to complete the legal system by learning the advanced experience from the developed countries.The first part of the article is to explain the basic meaning of soil pollution and soil remediation.Then the need for this study will be emphasized,besides,the basis of the theory of soil pollution control construction of legal system were to be discussed.The second part is to make a brief introduction the practice at the national level and the local level.Thus it comes out to be the conclusion that soil pollution control legal system of ours has the guiding ideology obsolete,legal dispersed,operability not strong and targeted weak features.The third part investigates soil pollution prevention legal system of other countries,to provide inspiration for the perfection of the legal system of contaminated soil remediation prevention legal system of our country.In the first place of the fourth part is the discussion about legislative mode of our country's soil remediation legal system shall be summarized.Secondly,put forward the recommendation that the single legislative mode should be chosen,so we need draw up Soil Pollution Prevention Law.Thirdly,the specific design focusing on restoration of contaminated soil legal system will be discussed,including the system of soil pollutioninvestigation and assessment,classification management system of contaminated site and the liability system of soil pollution prevention.Finally,propose another more recommendations to complete our country's soil remediation legal system which can be implemented effectively.
