With the rapid development of national economy,the problem of environmental pollution is also becoming more and more serious,in china.All kinds of environmental hazards occurred successively,which limits the sustainable and healthy development of the national economy in the future.In recent years,with the rise of environmental protection movement and the awakening of corporate social responsibility,we have aroused people’s reconsideration of corporate social responsibility and environmental protection.Environmental responsibility belongs to the concept of social responsibility,so enterprises should bear environmental responsibility.Environmental legal responsibility is not only closely related to the survival and development of the enterprise,but also is of great benefit to the healthy development of the economy and society.As a very special type of enterprises,commercial banks have great power to control the flow of credit and play a major role in guiding production enterprises to transform their development mode,so they should take more environmental legal responsibilities.Compared with western developed countries,the environmental legal responsibility of commercial banks in China is still in the primary stage.Because the environmental legal responsibility of commercial banks is not clear in the law,in addition,the commercial bank’s own awareness of environmental protection is weak,and the pursuit of profit maximization.The environmental protection of commercial banks is not significant enough.The theory of environmental externality,corporate social responsibility and bank environmental risk management provides a basis theoretical for commercial banks to undertake environmental legal responsibility.The adjustment of industrial structure,to maintain the sustainable development of economy and society,the bank’s own development is necessary for commercial banks to assume responsibility,the construction of ecological civilization and fulfill the social responsibility of the enterprise,in order to provide legitimacy for the efficiency and equity of commercial bank environmental responsibilityAt present,there are many policy norms about the environmental responsibility of commercial banks.Green credit is the most important way for commercial banks to undertake environmental responsibility.However,the absence of legislation on environmental legal responsibilities of commercial banks,unclear environmental responsibilities of commercial banks and inadequate attention to green credit have weakened the actual effect of environmental legal responsibility of commercial banks.With the experience of the United States,Germany,Canada,Japan and other countries,our country should establish the environmental legal responsibility of commercial banks.From the choice of the legislative path,the integration of legislation to establish the environmental legal responsibility of commercial banks is a better way of legislation.From the standard mode,the legislation of promoting environmental responsibility in the whole commercial bank is supplemented by promoting legislation and managing legislation.For improving the specific system of environmental responsibility of commercial banks,we should set up the duty of prudent loan examination,the obligation of environmental information disclosure and the supervision obligation of the loan in the commercial bank,and make clear the responsibility of the commercial banks to violate their obligations.Relying on the mandatory authority of the state,establishing the environmental legal responsibility of commercial banks can urge commercial banks to fulfill their environmental responsibilities and really achieve the purpose of environmental protection of commercial banks.
