| China’s environmental situation is increasingly grim,the Ministry of environmental protection in accordance with the "People’s Republic of China EIA law" formulated the "PEIA management approach",the contents of article twenty-seven of the EIA law were refined.PEIA refers to the preparation of environmental impact report documents of construction projects through completion and acceptance of environmental protection facilities and stable operation after a certain period of time,tracking and monitoring and evaluation of the effectiveness of the environmental impact of the actual production and pollution control,ecological protection and risk prevention measures,and put forward the remedy measures or methods to improve the effectiveness of the EIA.With the system.PEIA is a completely independent environmental legal system of EIA.A law to complete the EIA but still have adverse environmental impact of the construction project is only applicable to PEIA.Significant changes in the construction of the project does not apply to PEIA and the need for re approval of EIA.PEIA is able to improve forecasting methods,validate environmental design,implement environmental laws and reduce environmental risks.According to the reasons for starting the PEIA can be divided into two kinds of active and passive and active PEIA in the project was formally put into production or operation after three to five years of "normal operation" stage,the "normal operation" need to measure whether the design meets the load by 75%;passive by PEIA in order to carry out environmental protection departments when necessary.All EIA files should be applicable to PEIA,and should not be applicable to the PEIA EIA file is limited to the EIA report.The entire PEIA program includes the preparation stage,the stage of public participation and the preparation and filing of PEIA documents.We protect the smooth implementation of PEIA through environmental law enforcement and the legal responsibility of violating PEIA. |
