The Research On The Environmental Right Under The Perspective Of Marx’s Ecological Philosophy

As a new right,the environmental right was born from the background of the rapid growth of capitalist industrialization,the blind pursuit of natural resources and capital interests,which lead to the deteriorate of the environment.The environmental right hold on our best wishes to enhance the environment.What the nature,subject,object and the content of this right,we can not give the specific answer.The ambiguous nature restrained the development of this right,as a newborn baby,it can not do much good to our environment.So what we have to do at first is to detect the clear nature of this right.Marxism contains rich ecological thoughts of philosophy.It is based on the crisis between human beings and the environment situation and the actual living conditions,to provide powerful guidance for China’s construction of ecological civilization,and to define the right environment to provide theoretical support,is our first courses in the environmental research at present.Marx deeply analysis the causes of environmental problems,reveals the essence of the relationship between man and nature,requires people to straighten out his own position,live in harmony with nature.This essay studies from the following four aspects.The first part discusses the production and development of Marx’s ecological philosophy,and introduces the basic connotation,its main includes the priority position of nature,the importance of the harmonious relationship between human and nature,the contradiction between human and human is the key of the contradiction between human and nature,the significance to have a deep thought about the relationship between human and nature.The second part discusses the background and the relevant theories of environmental rights,and then analyzes the main views of the environmental rights,the positive and negative theory,after that,discusses the legislation and judicial situation in our today’s hectic country.The third part discusses Marx’s ecological philosophy is the theoretical basis and value guide.It provides value guidance towards the environmental problem,protects the environment,does good to our ecological civilization society.Marxism in China can combine the situation and the theory,persist in the sustainable development,it can bethe value guidance of environmental right.The fourth part discusses the construction of environmental right from the perspective of Marx’s ecological philosophy.The main reason lies in its legal nature,subject,object,content is fuzzy.Using Marx’s ecological philosophy to guide the environmental rights can limit the legal elements of the environmental rights in a reliable range,and give some suggestion about the legislation.
