The Research On Problems Of Corporate Environmental Legal Responsibility

Corporate environmental legal responsibility is the legalization of corporate environmental responsibility,it means corporations as the main body of the environmental law,oblige to behave in a certain manner to protect the environment.Protecting the environment includes not only preventing environmental pollution and ecological damage,but also protecting natural resources.The industrialization process in the past nearly 40 years since the reform and opening-up has created great productivity for our country,yet we have paid a huge environmental price for it.Environmental events are endless,and environmental pollution,ecology and resource destruction are appalling.It is fair to say that corporations undertaking their environmental legal responsibility is the fundamental solution to environmental problems in our country.To strengthen corporate environmental legal responsibility is the inherent requirement of ecological civilization construction,the meaning of "five development concepts" and the concept of sustainable development.The key to strengthening corporate environmental legal responsibility depends on environmental rule of law.The paper consists of five parts:The first part is introduction about the purpose and significance of this topic,the related research trends at home and abroad,and the research methods.The second part is the overview of corporate environmental legal responsibility.On the basis of defining the concepts and scope of environment and environmental law,this part defines the concept of corporate environmental legal responsibility,puts forward the opinion that corporate environmental legal responsibility is the legalization of corporate environmental responsibility.In addition,according to the division of environmental law system,this paper introduces legal provisions of corporate environmental legal responsibility.The third part is the realistic plight of corporate environmental legal responsibility and its causes.Through related data and cases,this paper expounds theserious consequences of the disregard of corporate environmental legal responsibility,and on these basis,makes an analysis of the causes.The basic reason why corporations ignore environmental legal responsibility is the low cost of illegal activities.The fourth part is the introduction and reference of corporate environmental legal responsibility in foreign countries.This paper introduces the legislation and strengthening mechanism of corporate environmental legal responsibility in the United States and Japan,and points out its reference significance to our country.The fifth part is the realistic path of strengthening corporate environmental legal responsibility.The realistic way to strengthen corporate environmental legal responsibility relates to perfecting legislation,strengthening environmental administration,promoting environmental justice and enriching environmental education.
