| In recent years,the government transformed to pay more attention on government functions,to enhance the quality of the environment,improving the efficiency of the funds’ usage for environmental protection and other considerations.By using the market mechanism to purchase environmental services,as a result it achieved vital effect.However it faces unsound laws and regulations,lacking of system security issues,the relevant theoretical research is almost in a blank zone.This report by using of some literature,to comparative analysis,case studies and other research methods,research on the legislation of China’s government procurement environment of public services,through the exploration of the current legislative situation,it could put forward improving laws and regulations,which could fill the gaps in the theory,as well as solve the realistic problems.It has certain theoretical and practical significance.From the legislative status quo,currently law of our country has not the legal aspects of government purchasing environment for public service provisions of administrative regulations,it just focus on the principle of affirmation and regulation of government purchasing environment for public services which is the main department regulations and local legislation.However,it still exist enough drawbacks.From the perspective of environmental public service of government,between the lower level of legislation,legislative conflicts,institutional framework design are not specific and micro.It lack of maneuverability,the law lags behind the practice problems.Focus on the government to buy public environmental services legislation design,there is a scope to buy the purchase which is not clearly defined,the program is not specific.The management system of performance evaluation and supervision,as well as inadequate design purchase pricing guidance not include enough social participation,which lacks motivation and other issues.Meanwhile,it still lack relevant regulations such as budget management lag,legal regulation of the PPP model.Stand on the successful foreign legislative experience and practice experience,our country need to promote the government purchase of public environmental services,it also need to establish a sound legal system and policy support,pay attention to the evaluation and supervision system is another efficiency measurement,while the introduction of competition mechanism,establish an incentive mechanism to ensure the participation of social forces.To analysis the legislative status quo and problems of China’s government purchase of public services should be based on the environment,combined with foreign experience,improving China’s government purchase of environmental public service legislation,to explore the legislative path right,clear the contents of the legislation are need to improve.From the legislative path,result in government buy public environmental services which need to improve the legislative level,legislative conflict and legislative lag problem between the department regulations and local legislation.At the same time,the current legislation conditions are not ripe or specified in the legal level,it is suitable for unified standards by administrative regulations,departmental rules and regulations by expand the purchase scope,the purchase of public service industry and environmental regulations and policies to refine the specific system by the government to make it workable.To pay attention to the division of the legislative authority of central and local.It needs to improve the content,should adopt the combination of top-down and bottom-up approach to determine the boundaries of government purchase public service environment,and to improve the design of evaluation supervision system combined with regulation,purchasing procedures,improving the enthusiasm of the participation of social organizations through preferential policies and the introduction of competition mechanism.In addition,we need to improve the budget management system and the regulation of PPP model. |
