| Land is both a farmer’s production and social security, but it is also a necessary conditions between the urbanization and industrialization. There have become intertwined socio-economic development between the various interests. Land expropriation is a major step in the course of promoting rural urbanization and industrialization. The infringement of farmland losers’legitimate rights and interests has become a central problem in this process. It is necessary for us to eliminate farmer’s problems of the so-called "there nongs".This article combines land expropriation and protecting equity of farmers in the expropriation process. We chose ten country areas according to the distance from CBD area and local economic status such as Gaoqiao, Baojia, Daling, Lanzhi, Zaocun, Shiping, Feiyun, PengjiaQiao, Xiaoyangkeng and Chongshou as targets for the research, field researching situations of farmers’equity protecting during the land expropriation process. Our research have found problems irrational that during the expropriation, villagers could hardly participate into the progress, the compensation is not reasonable, emplacements are not in place, a breach of the villagers’right to know, to participate, to supervise and to protest has occurred. Compensations for land expropriation and emplacement that the villagers deserve have no efficient guarantee. This article is based on current land policies, related law and government functions, analyzing reasons damaging famers’ rights and interests, come up with series of actions such as defining’land use-for-public-profits’clearly in law, improving culture quality of farmer species, developing rational compensation and interest allocation system, perfecting current land expropriation procedure, establishing social insurance system for farmers who lose land, achieving multi-emplace pattern, etc, targeting to inspire the public protecting farmers’legal rights and interests during the land expropriation procedure. |
