The outbreak of the financial crisis in 2008 made the shadow banking became a hot topic of attention, scholars at home and abroad has carried on the abundant research from the definition, statistical caliber, measuring scale, macro to micro impact, risk supervision and so on. In these studies, however, have not form a unified understanding, especially in the shadow banking itself contains the financial activities differ in thousands ways, properties of multifarious, and different countries shadow banking behavior is significantly different, so there are a lot of research space. Then, this article selects the closely related to the current economic and financial situation of the shadow banking risk regulation of further research, the purpose is build differentiated regulatory framework for representative types of shadow banking in our country, in order to enhance China’s shadow banking regulation efficiency.This paper argues that despite the rapid development of the shadow Banks make China’s capital and financial markets active, but the internal hidden risk of shadow banking also make the financial system becomes weak,so our government and relevant regulators also introduced some corresponding regulatory policy in recent years, but the regulation thinking still showed obvious administrative guidance, cause there are many regulatory loopholes and unclear in the process of execution supervision and regulation. In addition, most scholars believe that shadow Banks in China mainly include off-balance-sheet business of Banks and non-bank financial institutions and their business and so on, such as private lending should be clearly differentiate between different types of shadow banking risk, take different risk regulatory strategy respectively. But our country`s current regulatory approach is especially lacking in this aspect, highlights the existing financial supervision system in our country lack of flexibility and innovation in the face of changing the financial situation.It is regulated by differentiation as the core, this paper first analyzes the traditional theory of financial regulation and the emergence of the shadow banking brings challenge to the traditional theory of financial supervision and regulation, so need to thought of shadow banking risk regulation in China. Based on the analysis of the overall risk of China`s shadow banking, selected three kinds of representative shadow Banks. Based on their respective risk, risk factors and the analysis of the regulatory practice, put forward the necessity of the implementation of differentiation of China’s shadow banking risk supervision, build up shadow banking risk differentiation regulatory framework based on the risk factors. At the same time, considering the risk transfer between different types of shadow banking, establish a differentiated regulatory coordination mechanism, which brings out greater differentiation regulation effect. Finally, based on the above analysis, this paper on China’s shadow banking risk regulatory targeted policy suggestions are put forward, in order to provide the support of theory and practice to improve the shadow banking risk regulation efficiency in China.
