Study On The Relationship Between University Statutes And Modern University Institution Construction

Statutes of university as a programmatic document of the university autonomy, not only reflects the university’ requirements and expectations of Chinese education system, education laws and regulations, but also to a certain extent, reflects our state’s will of guiding university. Internally, it plays an important role in self-positioning, self-management and self-discipline. The modern university system, as the ideal model of development design, is a security system to ensure university’s efficient and benign operation. It works as a performer to carry out the objectives and tasks put forwarded by statutes of university. Along with the development of times and profound change of the social reform, a higher level of requirements for university’s construction and talent development. In view of this, to build a modern university system compatible with statutes of university becomes an important research topic.Using literature research method and comparative method, this paper makes a systematic analysis and comparison of the statutes of university and modern university system in different historical stages. Then evolution laws of both are found and meanwhile, some representative countries’ related successful experiences are concluded and summarized. It also analyzes current problems and causes of Chinese statutes of university and modern university system, finding that: our university statutes’ legal status is not clear, procedural content is imperfect, operability is not strong in the process of execution and personality characteristics lacks, etc. And our modern university system does not clarify clearly the relationship between university and government, society and university themselves. And meanwhile, the university’ internal management inefficiency is also a prominent problem. The fundamental cause of these problems mainly lies in our university lacking of subjective initiative under the influence of long-term official mentality.This study suggests that: statutes of university should first of all, to clarify its position and role of guiding modern university system from the legal level. At the same time, from the national level, statutes of university should constructed and completed from top to bottom. From academic level, integrating path of university statutes and modern university system should do bottom-up exploration from the aspect of theory and practice. The construction of a modern university system and university statutes should fully respect the history and culture in our country, absorb effective experience aboard. With the reality of our country national condition, it should around the concept of the party committee leadership, ruling the school by law, the principal responsibility, governing academic studies by professors, democratic management, university autonomy, academic freedom and social participation.
