As the new crime for Amendment to criminal law(nine),compare fabricating and spreading false public information crime with common information crime,we find that they have obvious characteristics.Although domestic legislation against some false information in related fields has made rules,but it is imperfect for social interests and national interests.At the same time,about outdoor`s legislation,the false public information crime in our country is insufficient,some foreign country`s legislative model is worth for us to study and research.Owing to the new crime,it is necessary to complete the crimes and the design of legal penalty.In the Judicial practice,some of the crime of false information has the same parts,so it`s essential that clarify the boundaries of this crime and others,analysis and class the accomplished offense standards and crime quality to solve the real problems.And the most important thing is according to the behavior`s harmful degree to affirm the measurement of penalty.It is deficient that fabricating and propagating false public information,such as the conception and incriminate standard is vague,the scope and kinds need to be expanded.So we should do the best on the perfection of legislation and judicial interpretation,only in this way can we punish the criminal`s behaviors and protecting the legal interests form harming.
