Study On The Legal System Of Labors Voluntary Retirement

In the traditional retirement legal system abroad,mandatory retirement age is a statutory dismissal cause and a precondition for receiving pensions.But in recent years,some countries repealed of mandatory retirement age provisions under the consideration of anti-age discrimination in employment,implemented the flexible state pension system and voluntary retirement plan.These measures are main contents of the voluntary retirement system The retirement legal system in our country focus on social security right.If laborers reach retirement age, the employing unit should apply for the state pension and end the employment contract. These are constraints on labour rights imposed by the state pension.This thesis analyses the voluntary retirement legal system in Britain,USA and Japan. We can learn their experience. We can remove the constraints on labour rights imposed by the state pension,and implement the flexible state pension system.
