China is facing a problem that how to participate in dealing with the national climate and the realization of climate justice, this is also necessary for every country to devote their effort. As many countries are solving the problem and the complex situation of benefits, we need a serious of documents in law, this may also affect the climate justice. Therefore, in the view of realization of climate and fairly distribution related laws, I analysed “United Nations Frameworkâ€, and the trade of it, I end up with a frame of Chinese strategy law. First of all, the key to realize the justice climate goal is correctly distribution of national climate law. Secondly, I analysis the national climate law. Since “Bali action planâ€, the more poor is the country, the more carbon is off emission, and the trade of this is less of justice. What’s more, I discussed the national law of climate control distribution. I believe for carbon emission, United States and European countries should pay for the poor countries. And United states and European countries should reduce their carbon emission, which will lead to more room for the poor countries’ development. At the same time, when developed countries have the same amount of carbon emission with the developing countries, the justice of national climate law will become uncertain. In the end, for the law of national climate stable, we should use the carbon emission divided by the population as a standard policy.In reducing carbon emissions, the United States, the European Union and other countries should pay the level of economic development.It is relatively backward countries to reduce the total cost of carbon emissions. In terms of carbon emissions, the United States, the European Union and other countries should cut their own carbon emissions, for the economic development level of the country’s economic development and social progress to set aside the necessary ecological space. At the same time, we should pay attention to, when the level of economic development is lagging behind national carbon emissions with the United States, the European Union and other countries tend to be more homogeneous and the justice of international climate law governing the allocation of rights and obligations will subsequently become uncertain. In order to make the stability of international climate law governing the allocation of rights and obligations of justice and clear should be to carbon emissions per capita in international climate law governing the allocation of rights and obligations as a standard, improvement of the climate change convention compliance mechanisms, and as the level of economic development is lagging behind the state and the United States, the European Union and other countries per capita emissions carbide homogeneity to participate in International Climate Governance to realize the importance of climate justice criteria, to establish fair and reasonable to reduce carbon emissions standards, developed countries should be formulated to support developing countries the timetable and route, and jointly promote the realization of fair allocation of rights and obligations, the global climate justice. |
