Research On The Improvement Of The Technical Investigation System Of Duty Crime Cases

Accompanied with the development of economy and science and technology level unceasing enhancement, the measures of technical investigation because of its secrecy and non subjectivity, high science and technology content is used more and more in the practice of criminal cases in.This paper aims to illustrate the general situation of technical investigation measure and does not deny the role at the same time, on the foundation of international law system principle, based on domestic and foreign legal practice, by means of technical investigation in corruption cases in the application of the research, the mechanism in our country gradually complete technical investigation measures is discussed.The article is discussed in four chapters. In the first chapter of investigating crimes committed in the investigation of technical measures must be used and discusses the practical significance and vice versa. The second chapter of technical investigation in the case of actual use of the technical investigation measures use rate is not high, there is the phenomenon of violations of human rights, the lack of relief program and other problems in this paper, the main legislation is not clear, investigative techniques is right to determine and implement right from five aspects. The third chapter of the United States, France, Japan, technical investigation measures in practice is studied in the paper, the measures of technical investigation of the mechanism of judicial review, France’s quasi judicial review mode, Japan’s strict examination and approval procedures, etc. for our better use of Technology Investigation and survey measures provides a very good reference. In the fourth chapter, from improving the duty crime investigation system should follow the basic principles and from perfect legislation, strengthen the measures of technical investigation of the use of supervision, increase capital and technology investment, the ascension from investigation department of the quality of policemen and perfecting the idea of China’s duty crime case technical investigation system.
