Empirical Analysis Of The Procuratorial Organ’s Supervision To False Lawsuit

In recent years, wise guy with ulterior motives puts civil procedure under his thumb, which creates a very bad influence in the judicial justice. To make the false lawsuit by malicious conspiracy, fictional facts, falsification of evidence, conceal the truth, turned into the tool that is used by individual for their improper interests,affecting the interest of the state,organizations or other individuals. More alarming,the false lawsuit affects the normal running of proceedings, has greatly wasted the judicial resources, hurts the authority and credibility of jurisdiction. In recent years,our country is building a credibility society, but there is still a long way to go. Moral corruption, valuable alienation, light punishment and the weak of law result in a lot of false lawsuit,which by hook or by crook. False lawsuit influences people’s legitimate rights and interests. False lawsuit has became serious bottlenecks constraining economic and social development.The cases striking false lawsuit of Zengcheng District People has four main features: large quantities, high proportion, various types and high success rate. The writer, as one participant of the experimental task in civil administrative supervision,has did most of the work striking false lawsuit accepting by Zengcheng District People.In the long-term work, the writer hold his perceptual knowledge and rational thinking of striking false lawsuit by handling mass and different cases. This thesis comes from the practice of procuratorial legal supervision, being derived from successful case by Zengcheng District People’s Procuratorate. This thesis try to definite the conception of the false lawsuit scientifically, introduce the types of false lawsuit and analyzes its characteristics and causes of formation. In the last part, the writer will put forward the corresponding countermeasures to prevent and strike false lawsuit.
