Research On Detection Mode Reform In Big Data Era

Recently, the combat between Alpha Go and Li Shishi is drawing people’s attention around the world. Alpha Go is able to predict the competitor’s thoughts of playing chess through data analysis therefore to win over the competitor by 4:1. We are so excited about this big advance of technology. At the same time, we would raise the question whether such technology could be applied to criminal detection, help to predict the crime area and runaway direction of criminals and arrest the criminals?The technology of big data opens a door for criminal detection with its powerful ability in criminal predictability and the whole-process recording. It gives the criminal investigator abundant information regarding a criminal case and therefore to break the information unequal situation between the investigator and the criminal. The criminal investigators can use the information collected by big data technology to locate relevant suspects and then arrest them. In addition, the detection department can allocate the police resources according to the prediction ability of the big data technology and therefore to lower the crime rate. In this perspective, detection in the big date era differs a lot from the traditional detection mode in methods, mentality and intervening time. In this case, not only can the big data technology be applied to detection but also make important influence to our nation’s detection mode.With the development of information-based society, our life is under the supervision anytime and anywhere, including the browsing history we leave on internet, the phone history, bank account information and the punch card information. When we touch something, we leave our footprints. So do the criminals. They can not separate themselves from our society for a long time. Once they put their hand on the information system, such data can be recorded by big data technology.This thesis put emphases on how would the big data technology affect the detection mode and how should we regulate such new technology when applied as an important detection method. I intend to introduce big data technology to make difference to the traditional detection mode. This thesis is divided into five parts, which are as follows:The first part is an overview of big data technology and detection mode, including the concept of big data, its characteristics and functions. In addition, this part introduces the detection mode in the big data background. And the detection mode in big data background conforms to our society development. Additionally, I elaborate the content and features of this detection mode and cite several examples with regard to the application of this mode nowadays.The second part is to prove that the big data detection mode is the necessary step for the detection mode reform. This part mainly explains the relationship between the big data era and the detection mode reform, which is, the big data era creates more opportunities for detection mode reform and therefore requires the traditional detection mode to change. This part demonstrates in detail the necessity and possibility of detection mode reform in the big data era.The third part is about the specific changes brought by big data detection mode, including changes in detection emphases, mentality and operational system. Specifically, the big data technology will change the emphases of detection process and the evidence collection rules, change traditional the belief in oral confession and form the detection thoughts of “from evidence to confession” and “from suspects to crimes”. In addition, the application of big data will bring about the predictive detection mode and allows the investigator to act proactively.The forth part states some misunderstandings regarding the application of big data in detection process. Although some other scholars have discussed the combination of big data technology and detection, I think there are some misunderstandings in their researches. Such misunderstandings are: the application of big data is irrelevant to the reform of detection mode; the combination of big data and detection is only about technology; the big data detection is a method but not a mode.The fifth part is the strategic framework of detection mode reform. This part mainly introduces the measures to help achieve such detection mode reform in the big data era, including the perfection of our law system, the change of idea, the development of technology, the culture of talents and the lessons from foreign experiences.
