Study On The Criminal Protection Of China’s Food Safety

In recent years, there are so many food safety incidents happened in our country,such as illegal cooking oil, Poisonous rice and so on. These substances often cause serious damage to human health. At the same time, as a kind of food additive, the security issues of Sudan Red have drawn people’s special attention, the safety of genetically modified food is also controversial. Criminal law, as the last protective field, its role is not only protect the legal interests, but it also protect human rights.This paper is divided into four parts, the topic of it is the Criminal Protection of China’s Food Safety. In the first part of the paper, the criminal protection of China’s food safety in every developing stage were introduced, it is aimed to catch the whole grasp of the development of the legal protections. In part II, by analyzing and reviewing the criminal protection of food safety, the paper expresses the author’s comprehension about the some parts fail of criminal law. The third part mainly discusses foreign countries’ criminal law protection of food safety and compared with that in China, in order to get benefit from it. The last part of this paper, the author gives us series feasible suggestion on how to improve criminal law protection of food safety in order to preventing and cracking down on the crimes about the food safety guarantee the legal rights of civilian.
