Study On The Infringement Of Network Forwarding

In the digital age, as the main way of information dissemination, the new media has qualitative difference with the traditional methods of information dissemination. In the era of new media, each one is the recorder and communicator of individual life and social events. Network forwarding as one of the most important means of information dissemination in new media age, not only making the dissemination of information more efficient, but also letting every network user can become information sharer and beneficiaries. While network forwarding bring convenience to our life, but it also has some legal risks. Ongoing violations caused by the network forwarding, such as video sharing site may involve copyright issues, the network forwarding may involve the infringement of privacy and reputation.This article is based on China’s current legislative status and defects, analyz on the infringement of network forwarding from forwarding subject, forwarding con-tent,forwarding way and forwarding consequence four aspects. The main contents of each chapter are as follows:The first chapter outlines the concept, way and characteristics of network For-warding, the present legislation situation and the defect of network forwarding in our country, and put forward that we should solve the problem of infringement aroused by network forwarding.The second chapter takes the difference of network forwarding subjects as the breakthrough point, dividing the network forwarding subjects into the network service providers and network users, specifically analyze the obligation’s size and the responsibility’s range of infringement caused by different subjects when forwarding.The third chapter takes the effects on infringement of different forwarding contents as the breakthrough point, specifically analyze the form and infringement when the forwarding content involving copyright infringement and infringement of four kinds of personality right.The fourth chapter takes the different forwarding ways as the breakthrough point,analyze the effects of different subjective mentality impact on infringement under different forwarding different forms. Divide into the system automatically forwarding,artificial forwarding and artificial intervention forwarding, which play the size of personal willpower in the forwarding process as the standard.The fifth chapter analyze the factors of judgment on the damage results should be considered under the network environment, from the harmfulness of forwarding content, the scurvies of forwarding means, and the universality of forwarding effect three aspects.
