Researching Organized Crimes Of Underword-like Organization And Recogniting It

This paper is divided into four chapters, chapter one introduced the concept of criminal group and underword-like organization,studied it on and learned it from various countries and regions inside and outside, as to reached the conclusion of this article. In addition,respectively,discussing the concept in law and in theory.Meanwhile, further analyzing the diffrence of underword-like organization from other releated organization.The second chapter focused on the unfinished form of oaganization,leading and participating the crime of underword-like organization.On one hand,stated the distinct opinion in criminal law,analyzed the controversial problems about it,and then stated the opinion of this article.On the other hand,affirmed the unfinished form of organizational behavior,leading behavior and paticipator behavior about this crime,and stated the reason of it.The third chapter discussed on the affirming of the crime of entering another country to expand members.On one hand,researched on the problem of subject of crime’s nationality,the reason to affirming the criminal group outside,then reached the viewpoint of this article and stated the reason of it;On the other hand,stated the meaning of the word‘entrance’and ‘development’and the viewpoint of the article.Chapter four analyzed the relationship between the subject of crime of protecting,conniving the underworld-like organization and the range of ‘umbrella’.This chapter affirmed the subject of crime and ‘umbrella’ respectively,discussed the problem of range of it and stated the viewpoint and reason of this article,so as to reach a concluion that they are equivalent in the range.
