In 2007, the first domestic online loan platform – ppdai was established in Shanghai, since then, the number of P2 P online loan platform almost rises with rapid growth. P2 P online loan solve the problem of SME financing to a certain extent, which greatly facilitates the lending transactions between the two sides, avoid private capital idle, achieve efficient allocation of resources. However, with P2 P platform popular, its defects become increasingly prominent. As some P2 P team has little ability of risk management, bad debt situations occur frequently, resulting in a lot of P2 P online lending platform collapse, and causing the heavy losses to the interests of creditors. At the same time, the relevant legal system is under development, some criminals even use the Internet to engage in money laundering and other illegal activities. Therefore, the establishment of relevant regulatory system has become an urgent problem to solve. In this paper, on the basis of relevant research results, analysis the various possible risks of P2 P online loan platform and puts forward the solving measures. The thesis consists of three parts, introduction, text and conclusion.The introduction first shows the recent failures of "P2P platform ",which leads to the theme that the P2 P online loan platform need the intervention of the legal regulatory, and introduces the research’s background and significance, the domestic and foreign research, research contents and research methods, innovation and deficiencies.The text mainly consists of four parts. The first part is the general theory of P2 P online loan platform operation: first of all, defines the research object. Secondly, introduces the main kinds of P2 P platform operation mode. Finally, carries on the discussion to the legal relationships. The second part introduces the regulation of the relevant institutions and possible risks. First introduced the regulatory status of our country’s financial supervision department, the administrative department of industry and commerce and communication management department, local government finance office supervision, and analyses problems that may arise under the existing legal framework of P2 P online loan platform operation. The third part of the main content focuses on the British and USA’s regulation on P2 P online loan platform and its enlightenment to china. The fourth part puts forward the legal countermeasures of improving China’s P2 P lending.The conclusion has made the induction and the summary to this article, emphasizing the importance of strengthening the P2 P legal regulation, once again expounds some thoughts and theories of the legal supervision of P2 P.
