| With the rapid development of the Internet and Cloud Computing, all the countries around the world have been turning to pay attention on the Big Data. As a result, the world is stepping into Big Data Era whose leading factor is the data. In 2012, U.S. has launched "the big data research and development program". Then, "National Data Strategy" has also been written in the 13th Five-Year Plan of China. It’s the evidence that China has determined to develop the big data.In Big Data Era, everyone is the producer of the big data, meanwhile, each one can be the damage party at any moment. How to balance the interest conflict between the personal information protection and the development of big data has been the coming difficulty of every country and region.Actually, according to Survey report on the protection of the rights and interests of Chinese netizen 2015, it’s stated that around 78.2% of netizen’s personal information has been divulged. Personal information protection has become an urgent problem. All circles of society has mouthed that we should strengthen the legal protection of personal information, hence, it is very necessary to explore the personal information protection system which is in line with the national conditions of our country.First, this thesis analyzes the connotation of personal information and introduces the new challenges facing the protection of personal information under the age of big data. Second, from the pointview of laws and regulations,and personal information protection status, this thesis introduces the existing problems of China’s personal information protection. Then, based on the comparative research methods, this paper discusses the protective mechanism of foreign countries and summaries the useful references for our country. Last, this thesis also proposes a new way to improve personal information protection under the times of big data.Creative thoughts in this thesis include:1. Based on the national development strategey, this thesis explores the issue of personal information protection into the background of big data era, which carries with great practical significance.2. In the analysis part of the connotation of personal information, besides the analysis of existing viewpoints, the author also focuses on the new changes of the emergence of a new era. That aims to help people to build a more comprehensive understanding the new challenges of personal information protection which are brought about by big data.3. When analyse the existing problems of domestic personal information protection, being different from previous methods such as cite practicalcases, this paper tries to explore from the angles of laws and regulations. In addition, this paper combines the dilemma of personal information protection to refine the inadequacies.4. In the improvement of personal information protection section, besides the proposal of building a legal protection mechanism system, this paper also makes targeted responses to all the problems especially on the existence of our personal information protection. |
