Research On Environmental Agreements Between The Governments

Intergovernmental environmental cooperation agreement is a model based on free contracts, which can effectively overcome the barriers of administrative divisions, achieve regional environmental linkage and used by levels of government generally.However, because environmental cooperation agreements between the governments started relatively late in China,it causes some regional environmental governance problems, such as the lack of the key content,low legal effect, incomplete and undemocratic making process, unreasonable operation mechanism, etc. In addition, the research of environmental cooperation between the governments is insufficient, and only a few scholars focus on research from the perspective of administrative laws and regulations.In this paper, based on the theory of administrative law and public management of governance, the author use the method of literature to analysis the intergovernmental environmental cooperation agreements from contents, legal effect, making process, and the operation mechanism so as to find the regional corresponding problems in intergovernmental environmental cooperation agreements, and puts forward countermeasures.The first part, introduction.First, introduce the paper background, significance of research,the core concepts.Then describe the foreigner related research.at last, highlight the research ideas and methods, the main research contents and possible innovation points.The second part, research on the present situation of the pearl river delta itergovermental environmental agreements.This part, use Sample method to anasly the species in the environmental agreements, the condition of content terms, efficacy, making process, the operation mechanism.The third part, analysis the problems and the reason existing in the pearl river deltaenvironment agreements between the governments. According to the second part,the author find it exists this agreements, such as incomplete content terms, low legal effect, incomplete and undemocratic making process, unreasonable operation mechanism, etc.The reason caused these problems summarized as: environmental agreement between the governments in China started late, our country’s legal system is not sound, the hierarchical effect and the assignment of the power between local governments is not enough.The fourth part, analysis and lesson the foreigner intergovernmental environmental agreements.In this part,I analyzes the content,law effect, procedures and operation mechanism of the foreigner environmental agreements, found that foreigner governmental environmental agreements are more perfect, scientific and have higher effectiveness hierarchy, and its program is normaller, and the performance of the agency authority is clearer, agencies participating and dispute settlement mechanisms are more diversified.The fifth part, it is about the countermeasures and Suggestions to better our country’s environmental cooperation agreements between the governments.This part is the key of the article.The author puts forward some suggestions to better the contents of this agreements,to improve the legal effect of the environmental administrative agreements, to perfect the procedure of environmental agreements, and to better the operation mechanism, etc.
