Sexual harassment has become the world widespread social problem at present,for the research of the problem can curb the spread of sexual harassment, protection of human rights, with the value and significance of the research.The paper proceeds with the definition and basic types of sexual harassment,from two aspects of occurrence place and seriousness of the classification, and from the subject, object, behavior and the behavior’s methods of responsibility of taking these aspects analyzes the legal nature of sexual harassment, help to better understand and grasp the legal nature of sexual harassment.By analyzing the anti-sexual harassment law in our country judicial present situation, it found that laws about sexual harassment in our country is still not to put forward the concept clearly, "sexual harassment" law is too institutionalized, practical operational is not strong and other shortcomings,and further generalizing to put forward three dilemmas of victims’ rights,namely public opinion lack of sympathy to the victims, difficulties of providing evidence easily lead to the victim losing,in most cases the compensation is difficult and the amount is low.In reference to the extraterritorial legislation against sexual harassment cases,this paper of Anti Sexual Harassment Law Regulation shortage and difficulties, by improving the prevention of sexual harassment legislative measures, judicial measures and preventive measures.The prohibition of sexual harassment rules can first shunt in the civil law, criminal law, labor law and other laws, combined with the judicial interpretation of sexual harassment at the same time.Carried out in a period of time, the first two full accumulated against sexual harassment of theory and practice experience, to formulate special law of regulating sexual harassment should be the best choice. At the same time, increase the employer responsibility, increase the accountability efforts,and the use of special configuration rules of burden of proof, change the victim too passive situation in forensics. |
