Study Of Local Legislative Deliberation System Of China

Since the legislative law of the People’s Republic of China revised, regional places has been revising their own legislative law by combining local legal system conditions. Comparing with previous local legislative laws, the revised ones are more.comprehensive in system and content. Among which, the deliberation parts undoubtedly are the most remarkable parts. As an important part of Legislative process, Legislative deliberation is the intermediate link of Proposal procedure and voting procedure and has its independent academic value. In the overview section, the notion and characteristic of Legislative deliberation has been discussed in detail. This paper treat substantive factors and procedural factors as system of improving frame, refine three ideas as value orientation. This essay conclude subject, object, basis, duty as substantive factors; participation, supervision factors as procedural factors. By using such logic, we can find the defect aspects in the deliberation system and reform existing deliberation system. For example, the integrating Function of Commission of legal Affairs could not work because the absent of obligation factors. The debating system could not work because the participation factor is absent. The Supervision System of Deliberation is not working because the absence of supervision factor is absent. This dissertation has summarized Democratic idea, efficient idea and reasonable idea to explicate the defect and remedy of the Legislative deliberation. Before that, the discussion of the necessity and feasibility has been put into action. For example, improving the process of traditional open system and new-media open system would be the efficient way to improve the Democratic idea in deliberation; the voting process should be built to improve the efficient idea in deliberation; the debating process and the challenge system could be built to improve the reasonable idea in deliberation.
