The Research On The Victim’s Forgiveness System Of Our Country

Since 1950 s, victimology has become a new subject. Victimology has continually made great breakthrough and developed a lot in this half century, such as the research scope has been enlarged and the content has been deeper gradually. In China, the victimology is a younger and immature subject, which is far behind the world. The present situation provides lots of research topics for the scholar. We have a variety of problems to be solved, no matter theoretically or practically.In our conventional criminal justice system, more attention is given to the country, the social benefit and the criminal. The victim’s behavior, effect and the protection of human rights are always ignored. As the retributive justice is introspected and challenged, the restorative justice gets more and more attention and develops very fast. It becomes the main trend that protecting the victim’s right and respecting their principal status in the criminal proceedings. There are lots of relevant provisions about the victim’s forgiveness system in the Criminal Procedure Law of China and a series of judicial interpretations. The victim’s forgiveness system has been mentioned continually in the report of the Supreme People’s Procuratorate. It has been more and more important, and it has been applied widely in the judicial practice. So, I decide to research the victim’s forgiveness system of our country.The first part is the summary of the victim’s forgiveness system, including the relevant conceptions, its significance and the differences between the victim’s forgiveness system and other similar systems.The second part is the legislative and judicial present situation of the victim’s forgiveness system in China.The third part mainly introduces the problems of this system.The final part is the suggestions and solutions.
