Research Of Death Penatly Review System In The Qing Dynasty

At present most of the academic research are focus Qing death penalty-review system on the court trial and the autumn trial, but for the same program as the death penalty review system of local and central trial has been neglected, even some studies do not think local and central trial proceedings are also parts of the death penalty review system. Qing has its own unique concept of justice, different with today, we can not use today’s concept to research Qing death penalty review system, By collecting the relevant literature of Qing dynasty, I believe that the review of the death penalty review system in Qing dynasty should not limited on the court trial and the autumn trial, but to extend our perspective, and found the true meaning of review in law of Qing dynasty, on this basis research related questions.This article is divided into five parts:The introduction of article mainly discusses the domestic and foreign research status, and then puts forward the significance of this topic.The first part start to the definition of the word "review", clear the true meaning of "review", analysis the different meaning of "review" in the law at that time, and probe how "the cautious punishment to kill" thought reflect in this system.The second part give the death penalty review procedure a comprehensive carding, by giving review procedure a detail canton to sort out their relations.The third part dissertate the except form of the death penalty review procedure in Qing dynasty-----"Execution on the Spot", by sort out the specific procedures of this and found the different between the death penalty review procedure.The fourth part talk about the feature of the death penalty review procedure in Qing dynasty, and put forward its significance for today.
