| The exercise of the power of Budget Supervision by Provincial People’s Congresses not only has the support of the traditional theory, but also has the distinctive features of the democratic era. It is the product of a series of political and economic development. The functioning of a State is inseparable with financial support. The State finance is one kind of public wealth that is taken from the people and giving back to people. The acquiring and using of State finance shall be bound by the rules which are recognized and complied by all citizens. As the authority that on behalf of the exercise of state power, the government holds the wealth of all citizens, and using it for the normal functioning of the government and people benefit. As the "financial manager" of all citizens, exercising all the powers of government should abide by the Constitution and the law. But any unfettered and unsupervised powers will inevitably be abused. There must have an independent power which can be independent with administrative power,and at the same time it can restrain and supervise the administrative power. This paper specifically analyzes a series of problems that exist in the process of Budget Supervision by Provincial People’s Congresses, using the analysis of basic theory and legal regulation system about Budget Supervision by Provincial People’s Congresses, and put forward a series of targeted recommendations.The paper due to be divided into five parts. Discussing values of Provincial People’s Congress Financial Budget Supervision from the perspective of power constraints and the democratic rule of law. Based on the discourse about the theoretical basis of the NPC budget supervision, this paper analyzes the constitutional basis about Provincial People’s Congress Financial Budget, and it demonstrates the rationality foundation of Provincial People’s Congress Financial Budget. To understand some objectivity and subjectivity conditions, this paper analyzes the power capacity, capacity and the responsibility mechanism that is necessary to exercise the power of Provincial People’s Congress Budget Supervision. The third part is mainly about the related System Guarantee that is needed by Provincial People’s Congress Financial Budget Supervision. The fourth part briefly discusses the legal regulation system about the exercise of the Financial Budget Supervision power of Provincial People’s Congress, and some specific reasons for the current problems. The legal regulation system mainly includes the provisions of the Constitution and other relevant specialized laws, among them, it mainly describes the provisions of the new "Budget Law". Through the analysis of the current status of the law, combined with the combination of the above basic theory and System Construction, compared with some excellent systems in other countries, it can analysis a series of problems that exist in the process that Provincial People’s Congress exercise Budget Supervision Power by the combination of theoretical foundation and the experience of the extraterritorial with China’s specific situation. In part five, the paper shall make some recommendations that can construct substantive budget supervision power exercised by Provincial People’s Congress. It mainly includes Constitutional level and Practical level. The last part is the summary of previously discussed. |
