A Research On The Patent Rights Legal Protection Of The High-tech Enterprises

With the development of intellectual economy and the aggravation of competition, intellectual property especially patent has become a strategic resource for corporations which leads to superiority in competition.High-tech enterprises with characteristic of high innovation,investment and profits have been the strong support to push the progress of technology and economy,which take a leading role in the development of national economy.The core technology is the base of the high-tech enterprises, it is inevitable for enterprises to enhance the core competitiveness through technological innovation,then it is necessary to protect technology innovation based on patent system.Thereby,legal protection of patent is of great significance during the strategic development of high-tech enterprises.Although patent protection for high-tech enterprises has gradually got attention,there is still a lot of problems existing in practice.In order to response the building of "Scientific Innovation Center" in Shanghai, the author try to make recommendations based on analysing the defect of legal protection and gain the experience of the developed country.The thesis can be divided into five parts as follows:The introduction part mainly explains background,theories,methods,innovation and deficiency of the research.The first chapter mainly introduces the theoretical foundation,firstly,is about the concept and features of the high-tech enterprise and the patent.Then emphasize the importance of patent rights legal protection to the high-tech enterprises while analysing the key points.The second chapter focus on the analysis of the status and bottleneck of the protection,from both macro and micro levels.The third chapter mainly discuss the legal protection of the high-tech enterprises in Japan and the USA.As the two countries are leaders in economy and patent protection,therefore there is a great benefit for us to learn from them.The last chapter is a sublimation to the foregoing analysis,starting from the existing problem of the he legal protection of the high-tech enterprise,making a conclusion from macro and micro levels.
