The Research On Chinese Anti-Domestic Violence Legislation

Nowadays, with the development of modern society, domestic violence has become a very serious global social problem. Domestic violence itself exposes many problems, which not only causes the majority of women’s physical and mental enormous damage, but also seriously infringes upon the legitimate rights and interests of the elderly, children and other vulnerable groups. As the advance of social civilization, domestic violence behavior needs to be effectively regulated and restricted with rules. Governments and experts have to study the anti-domestic violence, and they have achieved initial results. International anti-domestic violence has entered the legal area, many countries have established a relatively complete system of laws and policies against domestic violence. In contrast, China’s late start in this regard, until March 1,2016, China’s first anti-domestic violence on anti specialized laws-"Anti-domestic Violence Law of the People’s Republic of China" was officially open to the public. "Anti-domestic Violence Law" was promulgated and protect the effective protection of citizens’ rights, and promote family harmony unity, maintaining social harmony and stability, which it has important significance.I wrote this article which was based on previous studies, and I focused on the question of anti-domestic violence legislation. The paper is divided into 5 sections. The first part is an introduction, and preface discusses the seriousness of domestic violence, and through data analysis, hoping to arouse the reader and the public resonance. The second part is an overview of domestic violence. At the beginning, the paper described the definition of the concept of family violence, comparing home and abroad about the definition of domestic violence. In the end of this section, I talk about my own definition of domestic violence. Secondly, I analyzed the current situation of domestic violence. Address domestic violence is a pressing matter. Finally, I summarized the characteristics of domestic violence. It’s important to us in-depth study of family violence. The third part, I analyzed the specific reasons of domestic violence and harm. This gives us a better understanding of the problem of domestic violence. And the legislation is essential. The fourth part I introduced the legislation and measures which the advanced countries taken against Domestic Violence. Then I made some of these Comments. It is also an important reference value for our country. The fifth part, I concluded "Anti-domestic Violence Law of the People’s Republic of China" legislation highlights, and put forward opinions and recommendations to improve.
