The Study On Establishing The Supervision Legal System Of China’s Charitable Organizations

Charity is an important symbol of civilization and maturity of modern society. With the great changes in the international economic and social structure, the widening wealth gap and the increasing prominent social contradictions, the interests of disadvantaged groups deserve the special attentions which accelerate the speed development of charitable organizations around the world.China’s charitable organizations have developed around the world. However, there also has some phenomenon in recent years which shouldn’t be existed even against the trend such as “Thousands Yuan-tent in the Sichuan earthquake rescue”, “Thousands Yuan meal fee in the Red Cross of Luwan, Shanghai”, “Guo Meimei flaunting her wealth”, “The Hoper Project of Lu Meimei”, “The donation for Kelei in Nan Jing” with increasing social attention and still upgrading and other series of cases. It lead the image of China’s charitable organizations decreasing as fast as “Dominos”, seriously harm the sustainability of the charitable organizations’ development and even stir up the public’s dissatisfaction on the operation mode and supervision system of charitable organizations. It also leads the deep reflection of the government, philanthropic organizations and mass media. China hasn’t establish the juristic guarantee system with integrality and systematization and there exists series of problems such as relatively low legislative level, the disorder of legal norm structure and management, and the falling behind legislation contents, which cause donators, regulators and donee don’t establish effective relation, particularly the supervision of no avail, and can’t promote the “Sunshine Charity”. In such situation, it not only can’t promote the healthy development of charitable organizations, even will be an obstacle in the historical course of rule of law in domestic charity. So, based on the practical needs for China to establish and perfect legal supervision system of charitable organizations, the thesis proposes to promote the charity legislation and accelerate the optimization of supervision which will have great legalization significance.The first part is the introduction. In this part, the author organizes the research problems, summarizes the research overview and proposes the research approach and innovation efforts of the thesis.The second part, after analyzing the present situation of the legal system in charity supervision, the author proposes the significance of establishing the supervision system in charitable organizations with the development history of charity as basic thread.The third part, comparing with legislation system of the supervision charitable organizations in foreign countries, based on the China’s national conditions, the author has some suggestions on establishing the supervision system in charitable organizations.The fourth part, the author uses foreign experiences in the supervision of charity for reference and proposes the core of the thesis; and the choice in regulatory path of China’s charitable organizations.The fifth part, the author establishes the framework of charity supervision legislation contents which is basic principle, parallel development of different status legislation and setting the main content. In the sixth part, the author introduces several conclusions of the thesis and summarizes the suggestions for establishing the legislation supervision system in charitable organizations.
