Research On The Rights Protection Of Juvenile Inmates

Juvenile offenders who are being detained in juvenile detention facilities because of crimes are a special class of prisoners.They are minor children, and their rights are different from adult prisoners who are serving a sentence in prison. Our country takes a police of "Education first, punishment second" to the offenders under age.The content of juvenile prisoners’right protection has mainly stipulated in the documents of "Law of protection Minors"and other legal documents,in practice, the provinces of juvenile reformatories also have their own specific rules and practices.In the world, international law of "Convention on the rights of the child" together with "United Nations rules on protection of juvenile deprived of freedom", "United Nations juvenile justice standard minimum rules" and "United Nations rules on prevention of juvenile delinquency" has regulated the rights of juvenile prisoners.The international conventions and rules consistent with the spirit of the legislation of our country, most of legal regulation in our country.Developed countries, such as the United States, Germany, Japan,Russia and France also formulated domestic law provisions about the peculiar rights, and related specific operating mode, the rules and actual practices, to draw lessons from the good aspects in our country, the lessons of foreign also has a warning role.This article believes that our country are under the rule of law, though it has drew attention to the protection of special community, there are still some problems exists in the protection of juvenile prisoners’ rights. Such as the lack of law, the boundedness of rights content, and the limitation of realization of rights, which makes the rights of juvenile prisoners incomplete and it’s difficult to realize "enjoyed rights". This paper argues that reasons which lead to such situations are mainly include the legal operability, the special status of prisoners, and the thinking mode of law enforcement officers etc. According to these problems, this article put forward some suggestions,and hoping that the rights of juvenile prisoners in our country will be realized.
