The Financial Leasing Research Of Improvement Of Legislation

As a new kind of transaction form, financial leasing has a long history and a mature system in the developed country such as the USA, the EU and Japan, and it is promoting the development of the economy. But what a pity, it has been more than 30 years since the financial leasing appears. In the 30years, the financial leasing in our country developed rapidly, the sum of business transactions is more and more higher, but both of the performance are depends on the extensive growth model. Two reasons lead to the huge hidden danger in the financial leasing, one is the shorter develop history, the other is our incomplete law.There is two main legislation model about the financial leasing all over the world. One is no special legislation, it uses some relevant laws to govern, some developed country use this kind of legislation model. The other is special legislation, it uses the special law to govern. The latter fits us more. But we have no special law, we are supposed to get one.I have fore parts in my thesis. The first part gives the meaning and the history in our country. The second part introduces the current situation of the financial leasing lawmaking. The third part introduces the foreign experience about the financial leasing, including the special legislation and the no special legislation. The fourth part gives some suggestions to the financial leasing. It is my pleasure to make some contribution to our financial leasing.
