Study On The Protection Of The Rights And Interests Of The Disabled Elderly In Rural Areas

Lost to the elderly mainly refers to the male over 60 years of age, female over 55 years of age or older, because of disease, disability and other reasons caused by the physical function of the beginning of decline, and then lead to the loss of self-care ability, must take care of others to maintain normal life of the old people. According to the basic characteristics of the rural disabled elderly population and the degree of the activity of the activity, can be divided into three categories, namely, mild disability, severe disability and total loss of energy. Through the above analysis index, in out of bed, eating, bathing, toilet, Zen and walk around the six indicators, including 1-2 items cannot be independently become mild disability; 3-4 cannot independently of the degree of severe disability; 5-6 can independently be totally disabled; disability on the protection of the rights and interests of the elderly including survival rights protection, health protection of the rights and interests, nursing security rights and spiritual rights protection and other aspects. With the rapid development of social economy in recent years, China’s aging society is growing, according to the relevant statistics show that as of December 31,2014, the country over 60 years old people, including rural elderly people,143000000 people, accounting for 67.45% of the total number of elderly people, accounting for 18.16% of the total number of elderly people in rural areas, accounting for 76.62% of the total number of elderly people, accounting for 13.92% of the total.From this we can see that the number of disabled elderly in rural areas of China has been very large, and has become an important factor affecting the smooth construction of new rural areas, and has become one of the most important livelihood issues in China, must cause social, government and family, as well as to ensure that the human rights of the elderly in rural areas are fully guaranteed. With the development of reform and opening up, China’s industrialization and urbanization process speeding up, more and more young people go out of the countryside, and go to work in cities, resulting in a large number of the elderly in rural areas, some loss of life self-care ability of the elderly had no one to take care of, basic survival, health rights not fully guaranteed. From the current situation, China has not formed a perfect and effective solution to the problem of rural disability can not solve the problem of the rights and interests of the policy measures. How to make the rural disabled elderly happy life, to fully protect their legitimate rights and interests, which has become the concern of the party and the government a major livelihood issue, is also an important livelihood projects, a good solution to this problem to ensure every old man old can be depended on, and the elderly, there will be conducive to safeguarding the legitimate rights and interests of the disabled elderly, improve their quality of life, enabling them to dignity; is conducive to maintaining family harmony and stability and social harmonious development; is conducive to realizing the full completion of a well-off society development goals.Based on the importance of this issue, this paper on the theory of human rights as the basis, using empirical research methods, in-depth investigations and study, Jilin Province Nong’an County Ping Shan Cun lost to the elderly as the research object through to them by questionnaire investigation, visiting and talking, in-depth understanding of the basic situation of the elderly and their protection of the rights and interests of rural disabled. The investigation found that the main factors of rural disabled elderly people are facing the problems of material security, imperfect medical treatment, nursing service and single spirit life. These problems are mainly reflected in the following aspects:The national legal protection for rural disabled elderly is not perfect, the government of the rural disabled elderly living and medical insurance fund shortage, social management of nursing service for rural disabled elderly, lack of family care, backward degree of rural disabled elderly family in rural disabled old people is not in place and the rural disabled elderly autotrophic lack of nursing service; and measures in the end is put forward, which improve the rural disabled elderly living allowance system, improve the rural disabled elderly to establish legal aid system, rural disabled elderly care centers, nursing pension system construction, rural disabled elderly rural disabled elderly the spiritual support demand and the establishment of the rural disabled elderly mutual platform, so as to effectively solve China’s rural loss can lay a good foundation to protect the interests of the elderly problem. Therefore, we hope that this study can provide a certain reference value for the government, society and family to solve the problem of protecting the rights and interests of rural disabled elderly, so as to ensure that the rights and interests of rural disabled people are fully protected, so that they can have a very happy old age, which is also an important part of China’s livelihood issues.
