Especially in recent years, with the help of computer technology, electronic commerce has been thriving. The logistics enterprises in our country have been on the basis of the existing city integrated circulation business platform and broaden the horizon into global scale. In order to investigate the best logistics distribution model, improve the service management model of the logistics corporations, share and exchange the logistics information, improve the profit space of logistics enterprises and provide a wider space for the development of logistics companies, the logistics enterprises updated the technology platform of logistics information, constructed the large-scale central logistics park, established logistics transfer station and ect..And at the same time, compared with the logistics industry in western developed countries, China’s logistics industry fall behind in academic、technology platform、 construction of infrastructure financial support and the service concept. And the more significant thing is that many problems in the existence still not yet clear. For instance, the development of logistics developing goes back, the logistics legalities hasn’t yet clear, and the legal service platform has not been built up.In the first part of this paper, the development history of logistics is introduced in detail,this paper discusses the concept, features and functions of logistics, and introduces the definition of logistics, and analyzes the contents of legal relationship, and summarizes the basic meaning of logistics. The second part of the article is based on the present situation of our country’s legal system of logistics, the logistics legal system of our country exist in the analysis of the current development situation of legislation is not unified, and the principle of imputation uncertainty, supporting mechanism is not in place and other major issues, from the logistics laws and regulations in legislation and the practical application aspects are detailed, a general description of the society, history, technology and other aspects of the factors to the cause of the above problems, from multiple perspectives on the origin of the comparative analysis, revealing the source of problems. The third part of the article focuses on the development of logistics in the world, introduces the logistics and related laws of the United States, Britain and the United States, and analyzes the shortcomings of China’s logistics industry legislation. At the end of this paper, we focus on the problems existing in the Logistics legislation, including the complex and changeable legal relationship, the difficulty in defining the legal responsibility of logistics, and the definition of the standard of compensation.
