The emergence of the limited property house is in the 1990s’, due to the purchasing power is low, so a lot of people especially young people buy these houses to ease their pressure. At the beginning, the number of limited property house is small, relevant departments do not pay the attention on it. In recent years, with the trend of high price of commercial housing, scarcity of land, large-scale transformation of the old cities, in most villages inside large and medium cities, a lot of limited property houses are built.At present, it exists some negative influence of the limited property house. First, it seems to challenge the authority of the law, destroy the country’s land utilization overall planning and urban construction planning policy; at the same time, infinite expansion and development of the illegal use of the land will threaten the national farmland protection policy. Therefore, research on the limited property house problem has become the focus opinion of public.From the current social situation, the sale of the housing of small property right can not forbid, and these problems are becoming more and more prominent. Therefore, how to properly solve these problems will have to ensure the implementation of national policies of cultivated land protection, promote the steady development of city and rural areas, speed up the construction of new city. On the other hand, it will also be conducive to the healthy development of rural land circulation and rural economy.This paper is divided into six parts.The first part is the introduction of this paper, which mainly introduces the background of writing, the significance of the research, the current research literature, and so on;The second part is to define the "limited property house" in our country;The third part mainly analyzes the causes of the "small property right room" and introduces the existing problems;The fourth part analyzes the necessity and feasibility of its existence;The fifth part is the analysis of the legal way;The sixth part is the summary of the full text.The author through the analysis on the feasibility of the legalization of limited property house problem, put forward to the effective and reasonable regulation measures, so as to provide some theoretical support to solve these problems.
