Discussion Of Right About Meeting Between Detainees And Family Members In China

The field of international criminal justice attach importance to the rights of pending detainees with the development of the theory about Human rights,one of the rights is meeting.19, paragraph in"Protection of All Persons under Any Form of Detention or Imprisonment, principle"said except the situation in law any detainees should be allowed to meet famliy members."Standard Minimum Rules for the Treatment of Prisoners"show the same meaning.One important theory in international criminal justice field is confirm and protect the right of meeting between pending detainees and family members.At the same time,some countries make laws to protect the right of detainees.But in China,no matter in law or in practice,pending detainees can’t meet family members although human rights should be respected and protected has formulated in the Constitution and the Code of Criminal procedure.In the above situations,pending detainees can’t use the rights.Text of the article is divided into four parts.The first part analyze the status quo about the right about meeting in China,include legislative and judicial practice.Then make comments about the status quo.The second part expound the theories about protect the right of pending detainees.The theories consist of protect human right,defend the family and show the justice.The third part list laws international conventions about the right of pending detainees.And the final part put forward some advises to protect the meeting right of pending detainees by improve law and system.The family members not include defenders,and the article does not involve define family members.
